Asbestos removal is undertaken in accordance with Health and Safety at Work (Asbestos) Regulations 2016, and in accordance with the WorkSafe NZ Guidelines for the Management and Removal of Asbestos.


The new legislation places responsibilities on the Person Controlling the Business or Undertaking (PCBU) where the asbestos removal is to take place. Listed below are some of the important responsibilities with regards to this asbestos removal.


Duty of PCBU to inform certain persons about intended asbestos removal work. This regulation applies if the PCBU with management or control of a workplace is informed that asbestos removal work is to be carried out at the workplace. The PCBU must ensure that the following persons are informed that asbestos removal work is to be carried out at the workplace and when the work is to commence, before the work commences: 

  • The PCBU’s workers and any other persons at the workplace: b) The person who commissioned the asbestos removal work.

The PCBU must take all reasonable steps to ensure that the following persons are informed that asbestos removal work is to be carried out at the workplace and when the work is to commence, before the work commences: 

  • Any PCBU at, or in the immediate vicinity of, the workplace:
  • Anyone occupying premises in the immediate vicinity of the workplace.(Reference Health and Safety at Work (Asbestos) Regulations 2016 Part 3 r38)
